General Terms and Conditions
These terms apply to all orders placed through our online shop by consumers and by business customers.

1. Scope
The following terms and conditions apply to all orders placed through our online shop by consumers and by business customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business customer is a natural or legal person, or a partnership with legal capacity, who acts in the exercise of their trade, business or profession when entering into a legal transaction.
In relation to business customers, these terms also apply to future business relations without our having to refer to them again. If the business customer uses conflicting or supplementary general terms and conditions, their application is hereby rejected; they only become part of the contract if we have expressly agreed to them.
2. Contracting party, formation of contract
The purchase contract is concluded with Bear Family Records GmbH.
By presenting the products in our online shop, we make a binding offer to conclude a contract for these items. You can first place our products in the shopping basket without obligation, and correct your entries at any time before submitting your binding order, using the correction aids provided and explained in the order process. The contract is concluded when you accept the offer for the goods in the shopping basket by clicking the order button. Immediately after submitting the order, you receive a further confirmation by e-mail.
3. Contract language, storage of the contract text
The languages available for concluding the contract are German and English.
We store the contract text and send you the order details and our terms and conditions by e-mail. You can view the contract text in your customer login.
4. Delivery terms
Shipping costs may apply in addition to the stated product prices. You will find details of any shipping costs with the individual offers.
You always have the option of collecting your order from Bear Family Records GmbH, Grenzweg 1, 27729 Holste, Germany, during the following business hours: Monday to Friday, 9:00 to 18:00.
5. Payment
The following payment methods are generally available in our shop:
Payment in advance
If you select payment in advance, we will send you our bank details in a separate e-mail and deliver the goods once payment has been received.
Credit card
You provide your credit card details when placing the order. Once you have been verified as the legitimate cardholder, the payment transaction is carried out automatically immediately after the goods have been dispatched and your card is debited.
SEPA direct debit
By placing the order you grant us a SEPA direct debit mandate. We will inform you of the date on which your account will be debited (pre-notification). On submission of the SEPA direct debit mandate, we instruct our bank to initiate the payment transaction. The payment transaction is carried out automatically and your account is debited.
Your account is debited after the goods have been dispatched. The period for advance notification of the debit date (pre-notification period) is 14 days.
PayPal, PayPal Express
During the order process you are redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, verify yourself with your access data and confirm the payment instruction to us. After you have placed the order in the shop, we ask PayPal to initiate the payment transaction.
PayPal then carries out the payment transaction automatically. You will receive further information during the order process.
PayPal Plus
Under the PayPal Plus payment service we offer you various payment methods as PayPal services. You are redirected to the website of the online provider PayPal, where you can enter your payment details, confirm the use of your data by PayPal and confirm the payment instruction to PayPal.
If you have chosen PayPal as the payment method, you must be registered there, or register first, and verify yourself with your access data in order to pay the invoice amount. PayPal carries out the payment transaction automatically immediately after the payment instruction has been confirmed.
If you have chosen credit card as the payment method, you do not need to be registered with PayPal in order to pay the invoice amount. The payment transaction is carried out by your credit card company at PayPal’s request immediately after the payment instruction has been confirmed and you have been verified as the legitimate cardholder, and your card is debited.
If you have chosen direct debit as the payment method, you do not need to be registered with PayPal in order to pay the invoice amount. By confirming the payment instruction you grant PayPal a direct debit mandate. PayPal will inform you of the date on which your account will be debited (pre-notification). Submitting the direct debit mandate immediately after confirmation of the payment instruction, PayPal instructs its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.
If you have chosen invoice as the payment method, you do not need to be registered with PayPal in order to pay the invoice amount. After a successful address and credit check and once you have placed the order, we assign our claim to PayPal. In that case you can only make payment to PayPal with debt-discharging effect. Sofort by Klarna
After placing the order you are redirected to the website of the online provider Sofort GmbH. In order to pay the invoice amount via Sofort, you must have a bank account enabled for online banking, verify yourself accordingly and confirm the payment instruction to us. You will receive further information during the order process. Sofort then carries out the payment transaction immediately and your account is debited.
Amazon Pay
During the order process, and before the order is completed in our online shop, you are redirected to the website of the online provider Amazon. In order to process the order through Amazon and pay the invoice amount, you must be registered there, or register first, and verify yourself with your access data. There you can select the delivery address and payment method stored with Amazon, confirm the use of your data by Amazon and confirm the payment instruction to us. You are then returned to our online shop, where you can complete the order process.
Immediately after the order we ask Amazon to initiate the payment transaction. Amazon carries out the payment transaction automatically. You will receive further information during the order process.
Purchase on account and instalments with Klarna
In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer purchase on account and payment by instalments as payment options. Please note that Klarna invoice and Klarna instalments are only available to consumers and that payment must be made to Klarna in each case.
Klarna instalments: with Klarna’s financing service you can pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least €6.95). Klarna invoice: when purchasing on account with Klarna, you always receive the goods first and always have a payment period of 14 days. The full terms for purchase on account are available here: Klarna – invoice terms.
Invoice
You pay the invoice amount by bank transfer to our account after receiving the goods and the invoice. We reserve the right to offer purchase on account only after a successful credit check.
Payment by instalments
In cooperation with the online service provider Klarna we offer you the option of paying by instalments. This requires a successful address and credit check. In addition to our terms and conditions, Klarna’s terms and conditions and privacy policy apply to payment processing. Cash payment on collection
You pay the invoice amount in cash when collecting your order.
6. Retention of title
The goods remain our property until payment has been made in full.
The following applies in addition to business customers: we retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business; you assign to us in advance all claims arising from such resale in the amount of the invoice value – irrespective of any combination or mixing of the goods subject to retention of title with a new item – and we accept this assignment. You remain authorised to collect the claims, but we may also collect claims ourselves if you fail to meet your payment obligations.
7. Damage in transit
For consumers
If goods are delivered with obvious transport damage, please report such defects to the delivery agent as soon as possible and contact us without delay. Failing to make a complaint or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurer.
For business customers
The risk of accidental loss and accidental deterioration passes to you as soon as we have handed the item over to the forwarding agent, the carrier or the person or institution otherwise designated to carry out the shipment. Among merchants, the duty to examine the goods and give notice of defects under section 377 of the German Commercial Code (HGB) applies. If you fail to give the notice provided for there, the goods are deemed approved, unless the defect was not identifiable during the examination. This does not apply if we have fraudulently concealed a defect.
8. Warranty and guarantees
Unless expressly agreed otherwise below, the statutory law on liability for defects applies.
The following applies to the purchase of used goods by consumers: if the defect occurs more than one year after delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.
For business customers, the limitation period for claims for defects in newly manufactured items is one year from the passing of risk. Used goods are sold with all warranty excluded. The statutory limitation periods for the right of recourse under section 445a of the German Civil Code (BGB) remain unaffected.
In relation to business customers, only our own statements and the manufacturer’s product descriptions that were incorporated into the contract count as an agreement on the quality of the goods; we accept no liability for public statements by the manufacturer or other advertising claims.
If the item delivered is defective, we will initially provide a remedy to business customers, at our discretion, either by remedying the defect (rectification) or by delivering an item free of defects (replacement).
The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents:
- in the event of injury to life, body or health;
- in the event of intentional or grossly negligent breach of duty, and in the event of fraudulent intent;
- in the event of breach of material contractual obligations, the fulfilment of which is essential to the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations);
- under a guarantee, where agreed;
- where the scope of the German Product Liability Act applies.

9. Liability
We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents:
- in the event of injury to life, body or health;
- in the event of intentional or grossly negligent breach of duty;
- under a guarantee, where agreed; or
- where the scope of the German Product Liability Act applies.
In the event of a breach of material contractual obligations, the fulfilment of which is essential to the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations), caused by slight negligence on our part or on the part of our legal representatives or vicarious agents, liability is limited in amount to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
10. Final provisions
If you are a business customer, German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the German Commercial Code, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
